Términos de Uso y Condiciones – One West Realty (Honduras)
1. Aceptación de las condiciones de uso
El sitio web (el “Sitio”) es proporcionado por ONE WEST REALTY y One West Realty Grupo Inmobiliario, S.A., de manera conjunta referidas como la “Empresa”, y se pone a disposición del usuario sujeto a su aceptación plena, expresa y sin modificaciones de los presentes Términos de Uso y Condiciones (los “Términos”).
Estos Términos constituyen un acuerdo legal y vinculante entre el Usuario y la Empresa, y regulan el acceso, navegación y uso del Sitio, incluyendo cualquier contenido, funcionalidad, información o servicio disponible a través del mismo.
AL UTILIZAR EL SITIO, USTED: (A) reconoce que ha leído y comprendido estos Términos; (B) declara ser mayor de dieciocho (18) años; (C) acepta quedar legalmente obligado por los presentes Términos; y (D) declara que no ha sido suspendido ni restringido del uso del Sitio. Si no está de acuerdo con estos Términos, deberá abstenerse de utilizar el Sitio.
2. Firma electrónica y aceptación legal
La aceptación de estos Términos mediante medios electrónicos, incluyendo, pero no limitándose a, clics de aceptación, casillas marcadas (“Acepto”), ingreso de información, autenticación digital, confirmaciones electrónicas o cualquier otro mecanismo electrónico habilitado por la Empresa, constituye una manifestación expresa de voluntad y equivale legalmente a una firma manuscrita.
De conformidad con la Ley de Firmas Electrónicas de la República de Honduras, Decreto No. 149-2013, en particular sus Artículos 6 y 7, la firma electrónica y los mensajes de datos tienen la misma validez jurídica y probatoria que los documentos escritos y las firmas autógrafas, siempre que permitan identificar al firmante y reflejen su intención de obligarse.
En consecuencia, el Usuario reconoce y acepta que la aceptación electrónica de estos Términos es válida, exigible y plenamente vinculante, sin necesidad de firma física.
3. Modificaciones a los Términos
La Empresa se reserva el derecho de modificar, actualizar o sustituir estos Términos en cualquier momento y a su entera discreción. Las modificaciones entrarán en vigor de forma inmediata una vez publicadas en el Sitio. El uso continuado del Sitio constituye aceptación de dichos cambios.
4. El Sitio y su contenido
El Sitio proporciona acceso a información relacionada con bienes raíces, incluyendo propiedades residenciales, comerciales e industriales, así como información de financiamiento hipotecario y servicios relacionados.
5. Cuentas de usuario y seguridad
Para acceder a determinadas funcionalidades, el Usuario podrá requerir la creación de una cuenta personal. El Usuario se compromete a proporcionar información veraz, completa y actualizada y a mantener la confidencialidad de sus credenciales.
6. Comunicaciones SMS y consentimiento del usuario
Al proporcionar su número telefónico y otorgar consentimiento expreso a través de formularios electrónicos, casillas de aceptación (“Opt-In”), solicitudes de contacto u otros medios autorizados por ONE WEST REALTY, el Usuario acepta recibir mensajes SMS relacionados con servicios inmobiliarios.
Los mensajes SMS pueden incluir, entre otros: seguimiento de propiedades, confirmación de citas y visitas, actualizaciones sobre propiedades disponibles, información relacionada con servicios inmobiliarios, recordatorios, notificaciones de servicio, atención al cliente y soporte relacionado con consultas o transacciones inmobiliarias.
La información obtenida como parte del proceso de consentimiento SMS, incluyendo números telefónicos e información de suscripción a SMS, será utilizada exclusivamente por ONE WEST REALTY para comunicaciones relacionadas con sus servicios inmobiliarios. Los números de teléfono y la información de suscripción a SMS no se comparten, venden ni divulgan a terceros ni a empresas afiliadas con fines de marketing o publicidad.
La frecuencia de mensajes puede variar dependiendo de la interacción del Usuario con los servicios de la Empresa, consultas inmobiliarias, solicitudes de información, seguimiento de propiedades o necesidades de atención al cliente.
Pueden aplicarse tarifas estándar de mensajes y datos según el plan contratado con el proveedor de telefonía móvil del Usuario. Dichas tarifas pueden variar si el mensaje se envía de forma nacional o internacional.
El Usuario puede optar por recibir mensajes SMS mediante formularios en línea, solicitudes directas de contacto, registro en servicios ofrecidos por la Empresa o al marcar la casilla de consentimiento SMS correspondiente en nuestros formularios.
El Usuario puede cancelar la recepción de mensajes SMS en cualquier momento respondiendo con la palabra “STOP” a cualquier mensaje recibido. También puede solicitar su eliminación de nuestra lista de mensajería comunicándose directamente con la Empresa al correo electrónico info@1westrealty.com.
Para asistencia relacionada con mensajes SMS, el Usuario puede responder con la palabra “HELP” a cualquier mensaje recibido o comunicarse directamente con ONE WEST REALTY al correo electrónico info@1westrealty.com.
Si el Usuario no desea recibir mensajes SMS, puede abstenerse de marcar la casilla de consentimiento SMS en nuestros formularios. La participación en el servicio de mensajes SMS no es obligatoria para navegar por el Sitio.
Divulgaciones estándar: pueden aplicarse tarifas de mensajes y datos; la frecuencia de mensajes puede variar; el Usuario puede cancelar la suscripción en cualquier momento enviando “STOP”; para asistencia, puede responder “HELP” o contactarnos mediante la información indicada en estos Términos.
7. Servicios y enlaces de terceros
El Sitio puede contener enlaces a sitios web o servicios de terceros. La Empresa no es responsable del contenido ni de las prácticas de dichos terceros.
8. Licencia de uso
Se concede al Usuario una licencia limitada, revocable, no exclusiva y no transferible para utilizar el Sitio conforme a estos Términos.
9. Obligaciones del usuario
El Usuario se compromete a cumplir todas las leyes aplicables y a utilizar el Sitio bajo su propio riesgo.
10. Propiedad intelectual
Todo el contenido del Sitio es propiedad de la Empresa o de sus licenciantes y está protegido por las leyes de propiedad intelectual de Honduras y de los Estados Unidos.
11. Uso prohibido
Las siguientes actividades están estrictamente prohibidas:
Acceder a áreas restringidas sin la debida autorización.
Violar leyes locales o internacionales;
Suplantar la identidad de cualquier persona o entidad;
Utilizar el Sitio para fines no relacionados con servicios inmobiliarios;
Introducir software malicioso, virus o información falsa;
12. Renuncia de garantías
EL SITIO SE PROPORCIONA TAL CUAL Y SEGÚN DISPONIBILIDAD, SIN GARANTÍAS DE NINGÚN TIPO.
13. Limitación de responsabilidad
EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY, LA EMPRESA NO SERÁ RESPONSABLE POR DAÑOS DERIVADOS DEL USO DEL SITIO.
14. Indemnización
El Usuario acepta indemnizar a la Empresa frente a cualquier reclamación derivada del uso del Sitio.
15. Ley aplicable y jurisdicción
Estos Términos se regirán por las leyes de la República de Honduras. Cualquier controversia será sometida a los tribunales competentes de San Pedro Sula, Cortés, Honduras.
16. Acuerdo completo
Estos Términos constituyen el acuerdo completo entre el Usuario y la Empresa.

Terms of Use and Conditions – One West Realty (Honduras)
1. Acceptance of Terms of Use
This website (the “Site”) is provided by ONE WEST REALTY and One West Realty Grupo Inmobiliario, S.A., collectively referred to as the “Company”, and is made available to users subject to their full, express, and unmodified acceptance of these Terms of Use and Conditions (the “Terms”).
These Terms constitute a legally binding agreement between the User and the Company and govern access to, navigation of, and use of the Site, including any content, functionality, information, or services available through it.
BY USING THE SITE, YOU: (A) acknowledge that you have read and understood these Terms; (B) represent that you are at least eighteen (18) years old; (C) agree to be legally bound by these Terms; and (D) represent that you have not been suspended or restricted from using the Site. If you do not agree with these Terms, you must refrain from using the Site.
2. Electronic Signature and Legal Acceptance
Acceptance of these Terms through electronic means, including but not limited to acceptance clicks, checked boxes (“I Agree”), submission of information, digital authentication, electronic confirmations, or any other electronic mechanism enabled by the Company, constitutes an express manifestation of intent and is legally equivalent to a handwritten signature.
In accordance with the Electronic Signature Law of the Republic of Honduras, Decree No. 149-2013, particularly Articles 6 and 7, electronic signatures and electronic data messages have the same legal validity and evidentiary effect as written documents and handwritten signatures, provided they identify the signer and reflect the signer’s intent to be bound.
Accordingly, the User acknowledges and agrees that electronic acceptance of these Terms is valid, enforceable, and fully binding without the need for a physical signature.
3. Modifications to the Terms
The Company reserves the right to modify, update, or replace these Terms at any time and at its sole discretion. Any modifications shall become effective immediately upon posting on the Site. Continued use of the Site constitutes acceptance of such changes.
4. The Site and Its Content
The Site provides access to real estate-related information, including residential, commercial, and industrial properties, as well as mortgage financing information and related services.
5. User Accounts and Security
To access certain features, the User may be required to create a personal account. The User agrees to provide accurate, complete, and updated information and to maintain the confidentiality of their credentials.
6. SMS Communications and User Consent
By providing their phone number and granting express consent through electronic forms, acceptance checkboxes (“Opt-In”), contact requests, or other authorized means by ONE WEST REALTY, the User agrees to receive SMS messages related to real estate services.
SMS messages may include, but are not limited to: property follow-ups, appointment and showing confirmations, updates on available properties, information related to real estate services, reminders, service notifications, customer support, and assistance related to real estate inquiries or transactions.
Information obtained as part of the SMS consent process, including phone numbers and SMS subscription information, will be used exclusively by ONE WEST REALTY for communications related to its real estate services. Phone numbers and SMS opt-in information are not shared, sold, or disclosed to any third party or affiliated company for marketing or advertising purposes.
Message frequency may vary depending on the User’s interaction with the Company’s services, real estate inquiries, information requests, property follow-ups, or customer support needs.
Standard message and data rates may apply according to the User’s mobile carrier plan. Such fees may vary for domestic or international messages.
The User may opt in to receive SMS messages through online forms, direct contact requests, registration for services offered by the Company, or by checking the SMS consent box on our forms.
The User may opt out of receiving SMS messages at any time by replying “STOP” to any message received. The User may also request removal from our messaging list by contacting the Company directly at info@1westrealty.com.
For assistance related to SMS messages, the User may reply with the word “HELP” to any received message or contact ONE WEST REALTY directly at info@1westrealty.com.
If the User does not wish to receive SMS messages, they may choose not to check the SMS consent box on our forms. Participation in the SMS messaging service is not required to browse the Site.
Standard disclosures: message and data rates may apply; message frequency may vary; the User may opt out at any time by replying “STOP”; for assistance, reply “HELP” or contact us using the information provided in these Terms.
7. Third-Party Services and Links
The Site may contain links to third-party websites or services. The Company is not responsible for the content or practices of such third parties.
8. License to Use
The User is granted a limited, revocable, non-exclusive, and non-transferable license to use the Site in accordance with these Terms.
9. User Obligations
The User agrees to comply with all applicable laws and to use the Site at their own risk.
10. Intellectual Property
All content on the Site is owned by the Company or its licensors and is protected by intellectual property laws of Honduras and the United States.
11. Prohibited Use
The following activities are strictly prohibited:
Accessing restricted areas without proper authorization;
Violating local or international laws;
Impersonating any person or entity;
Using the Site for purposes unrelated to real estate services;
Introducing malicious software, viruses, or false information;
12. Disclaimer of Warranties
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR DAMAGES ARISING FROM THE USE OF THE SITE.
14. Indemnification
The User agrees to indemnify the Company against any claims arising from the use of the Site.
15. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the Republic of Honduras. Any dispute shall be submitted to the competent courts of San Pedro Sula, Cortés, Honduras.
16. Entire Agreement
These Terms constitute the entire agreement between the User and the Company.
